Reference case numbers 04-2-08824-4 and 04-2-08908-9, attached are decisions for your signature which, hopefully, accurately reflect your verbal decision at the hearing of December 10, 2004. I request that you sign and file a copy with the record. I also request that you return a copy to me for service to Karyn.
Also enclosed are copies of the Sheriff's 'RETURN OF NOT FOUND' which should already be part of the record. However, if they are not, I request that you add them to the record.
Lastly, enclosed are my memorandum of law, affidavit, and exhibits which I had prepared for presentation on December 10, 2004. I ask that you also include them in the record. As the motion was not timely, they are generally moot, but do demonstrate my on-going confusion between District Court Judges and Superior Court Commissioners and assist in explaining why the issues I will be raising on appeal had not been raised to the Superior Court.

THIS MATTER having come on for hearing upon the request of the Respondent on December 10, 2004 with the Respondent present and the Petitioner absent and the court finding that:
The Respondent had attempted service of notice via the Sheriff's Department but that no service had been made.
No continuance was appropriate as the motion was not filed within ten days of the decision of October 27. 2004.
IT IS THEREFORE ORDERED that the Motion to Revisit is denied.
The Respondent shall have the Petitioner served with a copy of this order via mail.
