Dear Mr. Carr:

You have recently sent a number of letters and documents directly to me as the judge who heard your motions for revision on December 10, 2004. The Code of Judicial Conduct, Cannon 3(A)(4), prohibits a judge from considering ex parte communications, that is, communications made directly to the judge without notice to all parties involved in the case. Under these rules, a judge is allowed to consider only pleadings filed with the Clerk of the Superior Court which meet the requirements for notice to both sides of the case. Documents need to be filed with the Clerk of the Superior Court, located on the first floor of the Courthouse, not by sending documents to a judge directly.

If you have requests or information for the judge, you will need to file documents with the Clerk and provide a copy to the opposing party and to the judge. Your filed document must show that copies have been sent as required.

With respect to the documents which have been received prior to this date, I have filed those documents with the Clerk, and have directed that copies be sent to the adverse party, Karyn. From this date forward, you will need to mail copies to Karyn, and file proof of mailing with your original documents.
