Dear Brian,
I have received the undated notice you sent me by U.S. mail as follows:
Hearing Scheduled
cases 04-08824-4 and 04-08908-9
Superior Court of Clark County in Washington
Department 6, Judge Johnson, 4th Floor
I noted that the stated date and time for the hearing of February 11, 2005 at
9:00 AM. It appears that the second numeral one (1) in the date was written
in pen or pencil over a computer-generated character, and that the
computer-generated character is indistinguishable, though it does have at its
base a small horizontal tail matching that of the numeral one (1) immediately
to its left.
Prior to the hearing date; I checked the Clark County Superior Court docket
online to verify that the schedule had not been changed prior to appearing
in court. I could not locate this hearing on Judge Johnson's docket on that
date and time. In fact, Judge Johnson had no docket on that date and time
whatsoever. I continued on to check every docket in all Clark County courts
for February 11, but could not locate our case.
I phoned and spoke with a woman in Judge Johnson's office who confirmed that
Judge Johnson was not scheduled on the docket for February 11. I then
described my situation and the woman assisted me. She recalled the document
in question and informed me that she, too, had thought it looked like
"February 1l." She also recalled others having thought the same. She mentioned
wondering about the February 11 hearing date previously, as there was no docket
for Judge Johnson on that date.
The woman further advised me that it was the Court Clerk's office that
actually assigned the docket, and that it was may have been possible that
someone in that office. having seen what appeared to be "February 11" assigned
the hearing to Judge Johnson's docket on the following Friday, February 18.
I advised her that I had not. (as of yesterday, February 10, 2005) received a
Notice of Hearing mailed from the Court or from you indicating that this hearing
had been scheduled for February 18, 2005-as opposed to February 11, 2005--and I
was not going to be available to attend the hearing as I already had arrangements
to be out of town.

I was advised to write you a letter telling you of the situation and to provide
a copy of the letter to Judge Johnson. I am sending this letter to you by
depositing it in a U.S. mailbox in NE Portland, OR on February 12, 2005.
