Re: Karyn v. Carr, Clark County Superior Court Cause No. 04-08824-4; and
Carr v. Karyn, Clark County Superior Court Cause No. 04-08908-9

Dear Judge Johnson,

I spoke with your office on the afternoon of Thursday, February 10, 2005 concerning a notice I received from Mr. Carr (enclosed):

Hearing Scheduled
cases 04-08824-4 and 04-08908-9
Superior Court of Clark County in Washington
Department 6, Judge Johnson, 4th Floor

Causes of Matter:
04-2-08824-4, Motion to Revise, December 28, 2004
04-2-08908-9, Motion to Reschedule, January 10, 2005
04-2-08908-9, Motion for Decision, January 14, 2005

Your assistant was most helpful and advised I write Mr. Carr a letter concerning the apparent written date of the hearing from Mr. Carr's notice, February 11, 2005, versus the Court Clerk's scheduled date of hearing, February 18, 2005, and the conflict with my schedule on the actual scheduled hearing date.

The letter I wrote to Mr. Carr is enclosed. It explains that I will be out of town on February 18. I have also enclosed a copy of the itinerary from my travel agent, including information on the non-refundable status of my airline ticket, for your information. I often travel up to 6-10 days per month, and must purchase tickets and make other arrangements more than two weeks in advance. I regret that I will not be in town on February 18, 2005; had I known of the correct hearing date enough in advance, I would have been better able to make advance arrangements.

I am a single mother with a busy career, an interstate commute, and a struggling consulting business. I have additional schedule conflicts from now through the end of spring vacation (mid to late-March). I do not wish to miss any hearings either now or in the future, but I am concerned about being overwhelmed by circumstance if not given time to properly receive notice and make appropriate adjustments in my schedule particularly given unusual or extenuating circumstances such as these.

I would have an attorney attend in my stead; however, the sheer number and complexity of legal actions, along with frequency of hearings both now and in the future, resulting from Mr. Carr's actions in both Clark County Superior Court and the Washington State Court of Appeals Division II makes it quite difficult for me to obtain such representative counsel, as the cost would be prohibitive, and I am "too rich to afford legal aid and too poor to afford an attorney" in this case.

I respectfully request that you give consideration to rescheduling the hearing in the Clark County Superior Court causes of matter described previously herein, currently on your docket for 9:00 AM on Friday, February 18, 2005 to a later date (preferably clear of spring vacation to avoid current schedule conflicts, but any rescheduling granted would be greatly appreciated) so that I may attend said hearing, and that I have opportunity to consult with the Court Clerk's office on said scheduling to assure that I will be available on the selected date before it is scheduled on the docket.

I also respectfully request that the Court Clerk's office, or other appropriate office or individual, contact Mr. Carr with any information as to change in scheduled hearing date or time.

Sincerely,

Karyn

Karyn
